Terms of Service

You must be at least 13 years old to create an account and use the App. By creating an account you confirm that you are at least 13 years of age. Users between 13 and 17 may only use the App under direct supervision of a parent or legal guardian who holds the account and accepts these Terms on their behalf. If you are under 13, you may not use the App.

Pencil2Reality is a mobile application that uses artificial intelligence (OpenAI gpt-image-1) to transform hand-drawn images uploaded by users into AI-generated artwork in a variety of styles. The App also offers an AI title generation feature. Both features operate on a credit-based system where each use consumes credits.

You may register using your email address, Google Sign-In, or Sign In with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@pencil2reality.app if you suspect any unauthorised use of your account.

Subscriptions are billed on a recurring monthly or annual basis through Apple App Store or Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. To cancel, manage your subscription in your device's App Store or Google Play account settings. We do not process cancellations directly.

Prices are set in the respective app stores and may vary by country. We reserve the right to change pricing; changes will be communicated via the app stores before they take effect.

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable regulations
• Upload images that contain nudity, violence, hate speech, or other harmful content
• Attempt to reverse engineer, decompile, disassemble, or tamper with the App
• Use automated scripts, bots, or other automated means to access the App
• Attempt to circumvent the credit system or payment mechanisms
• Interfere with the security, integrity, or availability of the App or its infrastructure
• Upload content that you do not have the right to use or share

Violations may result in immediate account suspension or termination without notice.

The App uses OpenAI's gpt-image-1 to generate images. The quality, accuracy, style, and appropriateness of generated images may vary and are not guaranteed. We are not responsible for the specific output produced by the AI model. Use of the App is subject to OpenAI's usage policies.

Generated images are provided for your personal use. You are responsible for ensuring that generated images comply with applicable law and do not infringe third-party rights before using or sharing them publicly.

If you are a consumer located in the European Union or European Economic Area, the following mandatory provisions apply:

All software, design elements, trademarks, and brand assets of Pencil2Reality remain our exclusive intellectual property. You are granted a limited, non-transferable, revocable licence to use the App for personal purposes only in accordance with these Terms. You may not reproduce, distribute, modify, or create derivative works from our intellectual property without our prior written permission.

The App is distributed via Apple App Store and Google Play. Your use of the App is also subject to the applicable platform's terms of service. In the event of a conflict between these Terms and any platform's terms, the platform's terms take precedence only to the extent required by that platform. Apple Inc. and Google LLC are not parties to these Terms and have no obligation to provide support or maintenance for the App.

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any particular result will be achieved from image transformation or title generation. Your use of the App is at your own risk. Nothing in this section limits rights that cannot be excluded under mandatory consumer protection law applicable in your jurisdiction.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of content, loss of profits, or loss of revenue, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) €50. Nothing in this section excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

You agree to indemnify, defend, and hold harmless Pencil2Reality, its operators, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App in violation of these Terms; (b) content you upload; or (c) your violation of any applicable law or third-party rights.

You may delete your account at any time through the in-app account deletion feature in the App settings, or by contacting us at support@pencil2reality.app. Account deletion results in permanent removal of your data as described in our Privacy Policy.

We reserve the right to suspend or terminate your account at any time if you breach these Terms, engage in behaviour harmful to other users or the service, or if required by law. We will endeavour to notify you unless prohibited from doing so.

We shall not be liable for any failure or delay in performance of our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, internet or infrastructure outages, third-party service failures (including OpenAI, Apple, or Google), or government actions.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any platform-specific terms incorporated by reference, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements, understandings, and representations.

We may update these Terms from time to time. Material changes will be communicated via the App, by email, or by posting a notice on this page with a revised “Last updated” date. Continued use of the App after the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the App.

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal. Notwithstanding the foregoing, if you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of domicile, and any mandatory consumer protection provisions of your country of residence apply.
